Working Before Being Approved

If you have applied for SSDI benefits but have not yet been approved, you may wonder how working will affect the success of your claim. At the Law Offices of Bruce K. Billman, we think that working before being approved is a win-win situation.

For one thing, if you attempt to work, and are able to, then that is a success in itself. You have proven that you can overcome hardship and be productive despite your medical condition.

On the other hand, if you try to go back to work, and are simply unable to because of your condition, you have a much more compelling case to bring before the Social Security Administration. You have proven to them that you are not a quitter — you want to work, but are simply unable to.

Working After Being Approved

If your claim has been approved and your SSDI benefits have been granted and you want to return to work, you have statutory rights in place under SSDI law. Even if you go back to work, you will only lose your SSDI benefits if:

  • You work more than nine non-consecutive months, and…
  • Your average per-month income is greater than $900

These protections allow SSDI benefit holders the chance at a trial work period to determine whether or not they are able to re-enter the workplace, without the risk of losing their benefits.
